Terms for short-term rental of boats

1. Cancellation

The Renter can cancel up to one week before the rental period begins without being charged. When the cancellation takes place between one week and 48 hours before the agreed rental period, the Renter must pay 50% of the agreed rental amount. In case of cancellations within 48 hours before the agreed rental period, the Renter will have to pay 75% of the rental amount.

If Kvalvaag Hytteliv og Hobbyfiske (hereinafter referred to as the “Company”) rents out the boat during the rental period, the compensation shall be reduced so that what the Company receives is deducted from the agreed rent. The Renter must still pay 10% of the rental amount when the cancellation occurs less than a week before the agreed rental period. This also applies if the cancellation is due to illness or death or other obstacles beyond the Renter's control, and which the Renter could not be expected to take into account. If the cancellation is due to weather conditions where the boat that is rented is unsuitable, or that serious deficiencies are discovered with the boat or equipment during check-out, the Renter shall not be charged. 

2. Renter Defaults

If the Renter does not use the boat during the agreed rental period without notifying the Company in advance, the Renter will have to pay the agreed rent for the entire rental period. If the Renter has rented the boat for several consecutive periods, the Renter must pay full rent for all periods that have not been canceled in advance.

If the boat or equipment in the boat on return is damaged beyond normal wear and tear and this is due to the Renter's negligence, the Renter must pay compensation. Any deductible in the event of insurance damage is then paid by the Renter.  

 

In the event of delayed return, the Renter must pay extra rent for the period that exceeds the agreed rental period. When the Company can document losses as a result of such late return beyond the rental price for the following rental period, the Renter is obliged to compensate this loss as well.

 

Boat and accompanying equipment must be cleaned by the Renter before return in accordance with the cleaning instructions that follow each boat. If the Renter returns the boat without having carried out such cleaning, the Renter will have to pay the Company for the cleaning corresponding to 50% of the rental price for a rental period. If lack of cleaning also delays renting to another customer, the Renter must pay a supplement corresponding to the rental price for an entire period. 

3. Company Defaults

If the boat is not ready for use at the agreed time, the rent must be shortened by the time that the Renter must wait for the boat to be prepared. If the delay is longer than half a rental period (2 hours), the Renter can choose whether he wants to maintain or leave the agreement.

If the boat is not in contractual condition, the Renter can demand a reduction in the rental price. If the defect is of a serious nature, the Renter can withdraw from the agreement.  

​

As soon as the Company becomes aware that the boat can not be used at the agreed time, or that the boat is not in proper condition, it must immediately notify the Renter.  

 

If the Renter can document losses as a result of the Company's default, the Company must compensate the loss. However, this does not apply if the Company proves that the breach is due to obstacles beyond its control and which it could not reasonably be expected to  consider.  See Interruptions.

4. Delayed Return, Engine Failure or Other Damage

If a situation or damage occurs during the rental period which means that the boat cannot be returned on time or in proper condition, the Renter must immediately contact the Company by telephone and inform about the situation. Theft or burglary that occurs during the rental period must be reported to the nearest police station or sheriff's office. The Renter and the Company must agree on how other damage is to be handled. 

5. Check-out

The Renter is obliged to document and demonstrate that he possesses the seamanship and the competence required for the boat being rented. The Company must check that the Renter has the necessary competence and practical seamanship, and that the Renter has the certificates or the age required to skipper the boat.

For the first rental, the Renter must, within first rental period, carry out at least one hour of check-out with the Company's representative. During check-out, the Renter and Company representative must together check that the boat, engine and necessary safety equipment are in proper technical condition. Emergency procedures, as well as check-out and delivery checklists must be reviewed. A test drive must also be carried out before the boat is handed over to the Renter.

If check-out shows that the boat, engine or required equipment is not in proper working order, the lease must be canceled. The Company must then repay the entire rental price to the Renter. 

If the Company representative during the check-out considers that the Renter does not have the necessary competence or practical seamanship required to ensure the safety of the boat, himelf or others boaters, the Company representative can demand that the tenant attends an up to 4 hours extended training during the first rental period. If the landlord considers that the tenant after the extended training still does not have the necessary competence and seamanship, the Company representative can choose to cancel any subsequent rental periods and pay all prepaid rent back to the Renter. If the Renter does not agree to receive extended training when the Company representative deems this necessary, the Company may choose to cancel the rental period without compensation to the Renter. The Company can then also refuse the Renter to rent again until he has completed the necessary additional training.

Check-out with a Company representative during the first rental period can only be omitted if it is obvious that the Renter has the necessary seamanship and expertise. Renters who has previously carried out a check-out together with a Company representative on the boat they are to rent are free to choose whether they wish to carry out a new check-out together with a representative the next time they rent.

6. Logging of Trips And Catches

The Renter is obliged to keep the boat log as instructed by the Company representative during check-out when this is part of the procedures for the boat being rented.

Renters that are not resident in Norway are also obliged to keep a catch log they use the boat for fishing. Catches must be reported to the Norwegian Directorate of Fisheries via the channels designated by the Company representative during the check-out. 7. Interruption

If the rental period is interrupted because the boat cannot be used for part of the rental period, and this is due to circumstances for which the Company is responsible, the rent shall be reduced proportionately. If the interruption is long-lasting, Renters can withdraw from the agreement if they feel the purpose of the rent has been significantly altered.

 

If the Company is forced to cancel later rental periods due to long-term technical problems, damage to the boat, engine, or other essential equipment requiring extensive or immediate repair, the Company is liable for the Renter's documented damage upwards to 50% of the prepaid rent for any rental periods starting within one week after the Company has given the Renter notice of such a cancellation. For rental periods that lie further ahead in time, the Company shall only repay any prepaid rent. 

8. Assignment of Lease

If the Renter is for any reason prevented from using the boat that he or she has rented, the Company cannot object to the transfer of the agreement to another person without due course. The terms herein will in any case apply to the person to whom the agreement is transferred, and the requirement for check-out for first-time Renters will apply if the person taking over the contract has not previously rented the boat to which the agreement applies.

9. Miscellaneous

The boat must be returned cleaned in accordance with the cleaning instructions that follow the boat, and be returned in such a condition so that the boat is ready for use by another customer in the following rental period. Deeper cleaning and maintenance is performed periodically by the Company.

The rent includes fuel and the Company is responsible for ensuring that there is enough fuel for one rental period aboard. If the Renter rents the boat for several subsequent periods, the Company and the Renter shall agree that the Renter fills the tank him or herself. The Company will repay such refueling against a receipt.

10. Disputes

All claims and disputes arising under or relating to these terms are to be settled by binding arbitration by a Consumer Council in Møre And Romsdal or another location mutually agreeable to the parties. An award of arbitration may be confirmed in a court of competent jurisdiction.
